Will Medicaid Take My Home If I Go Into A Nursing Home?
As a general rule, Medicaid is not in the real estate business and will not force your home to be sold. There are many ways to deal with a home, and the analysis depends on whether the person going into the nursing home is married or single. Either way, homes that are reasonably valued can be exempted from Medicaid determination. The difference has to do with what would happen to the home once the Medicaid recipient’s death occurs. Again, this depends on whether the person was singled or married. If single, the home or proceeds therefrom would be subject to Medicaid seeking repayment under Estate Recovery. If the Medicaid recipient is married, there are multiple strategies that can happen to protect the home from Estate Recovery.
